Jockey Wins Court Case

Star jockey Jamie Kah could return to the saddle as early as next weekend after her appeal to the Supreme Court of Victoria was in parts successful.

The premiership hoop challenged an additional two-month suspension for giving false and or misleading information to stewards during the investigation into an infamous Airbnb party in Mornington in August.

During Wednesday’s hearing Justice Richard Niall upheld one of Kah’s grounds of appeal, and in parts upheld another.

“Ms Kah was denied procedural fairness in that the findings made by the tribunal did not reflect the charge or the case made by the stewards,” Justice Niall told the court.

“I propose to make a decision setting aside the decision of the Victorian Racing Tribunal made in respect to the Plaintiff (Kah).”

The additional two-month suspension was initially enforced by Racing Victoria Stewards who claim Kah gave misleading answers to questions regarding the involvement of fellow Group 1 winning rider Mark Zahra at the gathering.

Kah’s legal team had always vigorously denied their client’s evidence was in anyway false or misleading.

Kah had previously accepted a three-month ban for her involvement in the illegal party – that suspension expires on the 25/11/2021, meaning the twenty-five-year-old could potentially be back in the saddle for Zipping Classic Day at Caulfield next Saturday.

The reigning premiership hoop could be the first of five suspended jockeys to return to race-riding after the Covid-breaching gathering - Mark Zahra, Ben Melham, Ethan Brown and Celine Gaudray all accepted their bans.

When will the jockeys return?

Kah - November 26

Gaudray - December 10

Brown - December 17

Zahra - December 27

Melham - February 18
